CONSENT & INDEMNITY DECLARATION RELATING TO RIDER PARTICIPATING IN MOUNTAIN BIKE SKILLS COACHING & GUIDANCE THROUGH RACHET – SCHOOL OF MOUNTAIN BIKING.

1. I agree to participate in the Mountain Bike skills coaching and guidance provided by the instructor/s of Rachet.Bike.

   I consent to the minor Rider’s participation in the Mountain Bike skills coaching and guidance provided by the instructor/s of Rachet.Bike on his/her behalf as his/her parent/legal guardian.
2. By virtue of the fact that the said Mountain Bike coaching by Rachet takes place at Holla Trails I understand that I/ the minor Rider, may need to become a member of Holla Trails and/or sign an indemnity in favour of Holla Trails and agree to comply in whatsoever manner required for me/the minor Rider to be allowed to use the facilities, trails, routes and paths at Holla Trails. I confirm that I have had sight of the Indemnity and Code of Conduct relating to access to Holla Trails and have accepted the said terms and conditions.
3. I accept the risks associated with the sport of mountain bike riding, particularly the fact that I/the minor Rider will be riding on uneven terrain, unmarked paths and routes. I acknowledge that there is a possibility that I/the minor Rider may fall from my/his/her bike or may injure myself/himself/herself or cause damage to my/his/her bike/property when partaking in coaching with Rachet.Bike.
4. I agree/will advise the minor Rider to listen to the guidance and direction of the instructor/s of Rachet.Bike, to adhere to the instructions that are given, to follow the rules imposed by the instructor/s and exercise reasonable caution at all times while engaging in coaching through Rachet.Bike.
5. I have disclosed any medical conditions, allergies, injuries or pregnancy that the instructor/s of Rachet.Bike need/s to be aware of which may pose an additional risk to the Rider while attending and participating in coaching with Rachet.Bike.
6. I acknowledge that the environment in which the coaching will take place is outdoors, is unpredictable and is not subject to the control of Rachet.Bike. I specifically acknowledge that burning of sugar cane is a regular occurrence on the premises, that fires can occur without forewarning being given to the instructor/s of Rachet.Bike, that the land is inhabited by snakes, bushpigs and other unspecified wildlife and that the instructor/s of Rachet.Bike do not have access to medical resources or facilities. Furthermore, I acknowledge that the instructor/s of Rachet.Bike can in no way guarantee my/the minor Rider’s safety arising from danger posed by wildlife, environmental variables or any other occurrence.
7. While every reasonable precaution for safety and care of the Riders is taken, I/the minor Rider participate/s in the coaching through Rachet.Bike entirely at my/his/her own risk and completely indemnify/ies Rachet.Bike and hold/s any instructor/s of Rachet.Bike harmless from all and any claim whatsoever and howsoever arising whether it be as a result of personal injury, death, loss or damage to my/his/her person or property of any nature, nothing excluded. This includes an indemnity against, among other things, recovery of costs that may result from such damage, loss, medical conditions, hospitalisation or replacement of goods.
